1. Acceptance

These Terms of Use (“Terms”) form an agreement between you (the “user”) and Clément Maldonado, sole trader trading under the business name “Maldonado Studio”, publisher of TourTap (the “publisher”). When you create your account, you expressly accept these Terms and our Privacy Policy. If you do not accept these Terms, you may not use the service.

2. Purpose

These Terms define the rules for accessing and using the TourTap mobile application and website, which allow users to discover events, take part in them and interact with other users.

3. Access and Minimum Age

TourTap is exclusively reserved for adults. By creating an account, you declare that you are at least 18 years old and have the legal capacity to accept these Terms. Any account created by a person under 18 will be deleted.

4. License Grant

TourTap is licensed, not sold. You are granted a personal, non-exclusive, non-transferable and revocable license to use the application for personal, non-commercial purposes, in accordance with these Terms. Any unauthorized reproduction, distribution, modification or commercial exploitation is prohibited.

5. Features

TourTap allows users to create and join events, chat through discussion threads and private messages, and view events on a map. The service is currently free. Paid features may be offered in the future; they would then be governed by separate sales terms made available to you before any purchase.

In addition to user-created events, TourTap displays, for information purposes, events from public external sources (event listings, organiser websites). The publisher does not organise these events, is not their author and is not affiliated with their organisers. The related information (date, place, description, etc.) is provided "as is", without any guarantee of accuracy or availability; you should verify it with the original source or organiser before travelling. Any rectification or removal request may be sent to support@tourtap.app.

6. User Conduct

When using TourTap, you agree not to:

  • break applicable laws or organize, through the service, any unlawful activity;
  • post unlawful, hateful, discriminatory, defamatory, violent or sexual content;
  • harass, threaten or intimidate other users;
  • disclose personal information about third parties without their consent;
  • impersonate others, create fake profiles or multiple accounts;
  • send spam or unauthorized commercial solicitations;
  • disrupt the operation of the service or attempt to bypass its security measures.

7. User-Generated Content

You remain the owner of the content you publish (photos, messages, events). You grant the publisher a non-exclusive, worldwide, royalty-free license, for the duration necessary to operate the service, solely to host, display, reproduce and moderate this content within TourTap. You warrant that you hold the rights to the content you publish and are solely responsible for it. When you delete your account, your content is erased in accordance with the Privacy Policy, subject to legal retention obligations.

8. Safety at Meetups and Events

TourTap is a service that connects people: events and meetups take place under the sole responsibility of the users who organize and attend them. The publisher does not organize these events and is not a party to them. Please be cautious: favor public places, let someone know, and stay alert during any meeting with a person you do not know.

9. Reporting and Moderation

You can report any unlawful content or behavior, or any breach of these Terms, using the in-app reporting feature or by writing to support@tourtap.app.

  • Each report is acknowledged and reviewed.
  • Where a moderation decision is made (content removal, suspension), the person concerned is informed with the reasons for the decision.
  • You may contest a moderation decision by contacting us within six months of that decision.
  • Regardless of this internal appeal, you may use an out-of-court dispute resolution body or bring the matter before the courts.

10. Intellectual Property

TourTap, its logo, visual identity and code are the property of the publisher and are protected by intellectual property law. This clause does not cover content published by users, which is governed by Article 7.

11. Personal Data

The processing of your personal data is described in our Privacy Policy.

12. Liability

The publisher provides the service with due care, under a best-efforts obligation. It is not a party to the interactions, events and meetups between users and cannot be held responsible for their actions or for the content they publish. To the extent permitted by law, the publisher's liability is limited to direct and foreseeable damages. Nothing in these Terms excludes or limits the publisher's liability for personal injury, gross negligence or willful misconduct, breach of an essential obligation, nor does it set aside the rights granted to consumers by law.

13. Service Availability

The publisher strives to keep the service available but does not guarantee continuous, uninterrupted access. The service may be temporarily suspended for maintenance or due to circumstances beyond the publisher's control.

14. Suspension and Termination

You can delete your account at any time from the app. In the event of a breach of these Terms or of the law, the publisher may, in a proportionate manner, restrict, suspend or terminate your access. Except in cases of urgency, risk to people's safety or legal obligation, you are informed of the reasons for the measure and have the right to contest it as set out in Article 9.

15. Distribution via the App Store and Google Play

The application is distributed via the App Store (Apple) and Google Play (Google), whose terms apply in addition to these. This agreement is entered into between you and the publisher, and not with Apple or Google, which are not responsible for the application or its support. Any purchase made within the application will be processed through the relevant platform (Apple on iOS, Google on Android), acting as seller or payment intermediary.

16. Changes to the Terms

The publisher may modify these Terms. In the event of a significant change, you will be informed by appropriate means before it takes effect. Continued use of the service after such notice constitutes acceptance of the new Terms.

17. Governing Law and Disputes

These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority. Failing that, the French courts have jurisdiction; if you are a consumer, you may bring the matter before the court of your place of residence or that of the defendant.
